Waraqi Terms of Use

1. Agreeing to these terms

Waraqi is a card game app published by HD Designs Studio Games LLC, 418 Broadway, Ste N, Albany, NY 12207, United States ("we", "us"). By making an account, playing as a guest, or otherwise using the app, you agree to these terms.

If you do not agree to them, do not use the app.

You must be at least 13 years old to use Waraqi. Where the law where you live sets a higher age for agreeing to terms like these online, that higher age applies to you.

2. Your account

You can play as a guest without an account. An account is needed for ranked play, for tournaments, and for the referral program; the rest of the app is open to a guest.

A guest exists only on the device it was made on. There is no sign-in to recover it with, so if that device is lost, replaced or wiped, the guest and what it earned cannot be recovered. Making an account keeps what the guest had, and is the way to carry it to another device.

• You sign in with Apple. Waraqi has no passwords of its own. You are responsible for the security of the account you sign in with.
• You choose a username. It is public: other players see it at tables, on leaderboards and in games they save.
• We may refuse a username that impersonates somebody, is offensive, or is one the game reserves for its own use.
• An account may be signed in on one device at a time. Signing in somewhere else signs the first device out.
• If you lose access, sign in again with the same service. There is no password to reset. You may connect more than one sign-in service to your account, and doing so is how you keep a way in if you lose access to one of them.
• We identify your account by the service you signed in with. If you sign in with a different service, that is a different account, and we have no way to know the two are the same person. Connect them from Settings instead.
• You may delete your account at any time from inside the app. Deletion cannot be undone. Some records are kept — see the Privacy Policy.

3. Automated players

Some of the players in Waraqi are operated by our software rather than by people.

Computer-controlled players are used to fill seats, to shorten the time you wait for a game, to keep games and tournaments running when not enough people are available, and so that the app is enjoyable to play at quiet times. They may appear in lobbies, at tables, in tournaments and on leaderboards, and they are not always labeled as automated.

This means you should not assume that another player you encounter is a person. The app makes no representation that any particular opponent is human.

Automated players follow the same rules of play as everybody else. They are not given cards, information or advantages that a person in the same seat would not have.

4. Virtual items, coins, gems and tickets

Waraqi contains virtual items: coins, gems, game tickets, card decks, table themes, avatars and titles.

These have no monetary value. Specifically:

• They are a limited, personal, non-transferable license to use a feature of the app. You do not own them.
• They cannot be exchanged for money, goods, or anything of value outside the app, by us or by anybody else.
• They cannot be sold, traded or given to another player.
• They are not refundable, except where the law or the app store's own rules require a refund.
• We may change what things cost, what they do, and what is available.
• If your account is closed, or the app is discontinued, unspent virtual items are lost and are not compensated.

Waraqi is not gambling. No real money is at stake in a game, what is won in a game has no monetary value, and there is no way to cash out. Entering a game costs a game ticket, which is earned in ordinary play and can also be bought; what you win is virtual items.

5. Purchases and the AFG Pass

Purchases of gems, coins and other items are made through the app store you installed Waraqi from, under that store's payment terms. We never see your payment details.

The AFG Pass is a subscription:

• It is charged US$2.00 per week and renews automatically until you cancel it.
• You cancel it through your app store account, not through us. Canceling stops the next renewal; it does not refund the current one.
• Its benefits (increased coins and experience, doubled rewards on claims, custom quick buttons, no advertising banners) apply only while it is active.

Refunds are handled by the app store under its own policy.

6. Ranked play and fair play

Ranked games affect a rating and a rank that other players can see. To keep them meaningful:

• Ranked play requires an account and some experience in the game concerned.
• You may not use any program, script or device that plays for you, read another player's cards, arrange results with another player, or use more than one account to affect a game's outcome.
• Leaving a ranked game before it ends is recorded as a loss and may cost you rating and the right to queue for a period.
• We may adjust or reset ratings, and remove players from leaderboards, where we believe results were not honestly obtained.

7. How you must behave

Do not, in chat or anywhere else in the app:

• harass, threaten, bully or abuse another player;
• post content that is hateful, sexual, violent or illegal;
• impersonate another player, or us;
• share anyone's personal information, including your own;
• advertise, spam, or try to sell anything;
• attempt to break, overload or gain unauthorized access to the app or its servers.

8. Reports, moderation and ending your access

Any player can report another. Reports are reviewed by a person, not by an automated system.

We may warn a player, restrict their access to parts of the app, or close their account, where we believe these terms have been broken. We will say what was decided. Serious or repeated conduct may end access permanently.

We may also suspend or end access if it is necessary to protect other players or the service.

9. Creating your avatar

A custom avatar turns two photographs of your face into an avatar drawn for you.

By buying one you confirm that:

• the photographs are of you;
• you are the person appearing in them and you have the right to use them;
• they show you modestly dressed.

You give us permission to use those photographs for the sole purpose of making your avatar, to have a person look at them in order to do so, and to have them shown to the image service that draws the artwork. They are not used for any other purpose. They are deleted once the order is finished, whether the avatar was made or the order was refunded. We may refuse and refund an order.

Nothing measures your face: there is no face recognition, no comparison against anybody, and no record of your features is created or kept.

Your custom avatar is a virtual item under section 4.

10. Content you provide

You keep whatever rights you have in what you write and send. You give us permission to store it, show it to the players it is addressed to, and keep it as described in the Privacy Policy so that reports can be looked into.

You are responsible for what you send.

11. The app is provided as it is

We work to keep Waraqi running, but we do not promise that it will always be available, uninterrupted or free of faults. Games may be interrupted by network problems, maintenance or server restarts.

To the fullest extent the law allows, the app is provided "as is", without warranties of any kind, and we are not liable for indirect or consequential loss, for lost virtual items, or for lost progress. Nothing in these terms limits liability that cannot lawfully be limited — including for death or personal injury caused by negligence, or for fraud.

Where we are liable to you despite the above, our total liability for all claims taken together is limited to the greater of the amount you paid us in the twelve months before the claim and US$50.

12. Changes

We may change these terms. If we do, we will update the date above and tell you in the app. Continuing to use Waraqi after a change means you accept it. If you do not accept a change, stop using the app and delete your account.

13. Law

These terms are governed by the law of the State of New York, United States, without regard to its conflict-of-law rules, and the state and federal courts sitting in New York have jurisdiction.

If you live somewhere whose law gives you rights that cannot be signed away, this section does not take those rights from you.
